1. About These Terms

These Terms and Conditions ("Terms") govern your use of cottagecountryoutfitters.ca (the "Site") and your purchase of products and services from Cottage Country Outfitters, a division of N49 Management Ltd. ("CCO", "we", "us", "our"), incorporated under the laws of Ontario (HST 708560560 RT0001).

By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

We may update these Terms from time to time. Continued use of the Site after an update constitutes acceptance of the revised Terms, except that material changes will be posted with reasonable advance notice and, where required by law, will not apply to you until you have been notified.

2. The Better Tools Standard

CCO curates products against a proprietary product evaluation framework called the Better Tools Standard. This standard is a curation tool — it reflects CCO's judgment in selecting products we believe will reduce time, reduce stress, reduce decision fatigue, prevent mistakes, improve safety, improve longevity, or increase enjoyment at the cottage.

The Better Tools designation is not a manufacturer's warranty and does not create any additional warranty beyond those provided by the manufacturer. CCO makes no guarantee of any specific outcome or result from any product listed on the Site.

3. Products & Pricing

3.1 Product Descriptions

We make every effort to accurately describe our products. However, we do not warrant that product descriptions, images, or specifications are error-free. If a product you receive materially differs from its description, you may return it in accordance with our Return Policy. This is in addition to, and does not limit, any rights you have under applicable consumer protection legislation.

3.2 Pricing

All prices are in Canadian dollars (CAD) and are subject to change without notice. Prices shown at the time of checkout are the prices that apply to your order.

3.3 Availability

Product availability is subject to stock at our suppliers. We will notify you as promptly as possible if a product in your order is unavailable and will offer a refund or replacement.

3.4 Seasonal Guides

Digital products, including CCO Seasonal Guides, are available to non-members at the price displayed at the time of purchase. Digital products are delivered electronically upon payment confirmation and are licensed for personal, non-commercial use only. Digital products may not be reproduced, redistributed, or resold. All sales of digital products are final — no refunds are available once a digital product has been delivered.

4. Orders & Payment

4.1 Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order. A binding contract is formed when we confirm your order by email.

4.2 Payment

Payment is required in full at the time of order. We accept Visa, Mastercard, American Express, and Shop Pay through Shopify Payments. All transactions are processed securely through our payment provider.

4.3 Taxes

Applicable HST and other taxes will be added to your order at checkout based on your shipping address and the applicable provincial rates.

5. Shipping & Delivery

Most CCO products are fulfilled via a drop-ship model, meaning your order is shipped directly from our supplier to your address. Regardless of fulfillment method, CCO is the seller of record and remains responsible to you for the products it sells. Estimated shipping times are provided on each product page and at checkout. Shipping times are estimates only and are not guaranteed.

CCO is not responsible for delays caused by carriers, customs, weather, or events beyond our control. Risk of loss passes to you upon delivery to the carrier.

We currently ship to Canadian addresses only. We do not ship outside Canada at this time.

6. Returns & Refunds

6.1 Return Window

Physical products may be returned within 30 days of delivery, provided they are unused, in original packaging, and accompanied by proof of purchase.

6.2 Return Process

To initiate a return, contact us at contact@cottagecountryoutfitters.ca. We will provide return instructions including a return authorization and confirmed return address, which may be a CCO facility or the fulfilling supplier's returns facility depending on the product. Do not return products without first contacting us.

6.3 Return Shipping

You are responsible for return shipping costs unless the return is due to a defective product or an error on our part. We recommend using a trackable shipping method — we are not responsible for returns lost in transit.

6.4 Refunds

Approved refunds will be issued to your original payment method within 5 business days of our receipt and inspection of the returned product. Please allow an additional 3-5 business days for your financial institution to post the refund.

6.5 Exclusions

The following are not eligible for return: digital products (Seasonal Guides), products marked as final sale, and products that have been used, damaged by the customer, or returned without original packaging.

7. My Cottage Property — Membership

"My Cottage Property" is CCO's free membership and property profile programme. By registering, you agree to the My Cottage Property Terms of Participation, which are incorporated by reference into these Terms. Key terms include:

  • Registration is free. You may cancel your membership at any time by emailing contact@cottagecountryoutfitters.ca.
  • Member benefits include free access to CCO Seasonal Guides, seasonal product recommendations based on your property profile, and early access to new products and collections.
  • Photo submissions to the CCO Community Gallery are subject to the User-Generated Content Licence below.
  • We will not sell your personal information to third parties. See our Privacy Policy for full details.
  • By registering and providing property information (lake name, region, province, property type), you consent to CCO using that information to personalise product recommendations and guide content delivered through the Site and by email.

8. User-Generated Content

By submitting any photograph or other content ("UGC") to CCO through the Community Gallery, photo submission programme, or any other channel, you grant N49 Management Ltd. a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, and distribute your UGC on our website, social media channels, and marketing materials, with attribution to you (your name and lake/region, as you provide).

You warrant that: (i) you own or have the right to submit the UGC; (ii) the UGC does not infringe any third party's rights; and (iii) you have obtained consent from any identifiable individuals pictured. You retain ownership of your UGC. You may withdraw consent for future use of your UGC by written notice, but this withdrawal does not apply retroactively to uses already made.

9. Intellectual Property

All content on the Site — including text, images, graphics, logos (including the CCO oval badge and the Better Tools mark), and the Seasonal Guides — is the property of N49 Management Ltd. or its content suppliers and is protected by Canadian copyright and trademark law. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CCO's total liability to you for any claim arising from your use of the Site or purchase of any product shall not exceed the amount you paid for the product giving rise to the claim.

CCO is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Site or any product, even if CCO has been advised of the possibility of such damages.

Nothing in these Terms limits or excludes any rights, warranties, or remedies you have under the Consumer Protection Act, 2002 (Ontario) or equivalent consumer protection legislation in your province or territory of residence, which apply notwithstanding any other provision of these Terms.

11. Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Ontario. Nothing in this Section deprives you of the protection of, or access to the courts under, mandatory consumer protection legislation in your province or territory of residence.

Before commencing any legal proceeding, you agree to contact CCO at contact@cottagecountryoutfitters.ca and attempt to resolve the dispute informally within 30 days.
